The U.S. Food and Drug Administration (FDA) has agreed to remove content from its website and social media platforms that warned against the use of ivermectin to treat COVID-19, following a settlement reached in a lawsuit. The settlement, announced Thursday, marks a significant shift in the FDA’s messaging regarding the controversial drug.

Under the terms of the settlement, the FDA will take down its consumer update titled “Why You Should Not Use Ivermectin to Treat or Prevent COVID-19,” which featured a doctor and a horse and was posted on March 5, 2021. Additionally, within 21 days, the FDA will remove social media posts from Twitter, LinkedIn, Facebook, and Instagram that discouraged the use of ivermectin for COVID-19 treatment. These posts included messages such as “You are not a horse. You are not a cow. Seriously, y’all. Stop it.”

The plaintiffs in the lawsuit, Dr. Mary Talley Bowden, Dr. Paul Marik, and Dr. Robert Apter, hailed the settlement as a victory for patients and the patient-physician relationship. Dr. Marik, chief scientific officer of the Front Line COVID-19 Critical Care Alliance (FLCCC), emphasized the broader implications of the case, asserting that it extends beyond ivermectin to address the authority of the FDA and the rights of physicians to prescribe medication.

In response to the settlement, an FDA spokesperson emphasized that the agency has not admitted any violation of law or wrongdoing. The FDA maintains that it has the authority to communicate with the public regarding the products it regulates, including issuing warnings about drugs like ivermectin. The agency reiterated that it has not authorized or approved ivermectin for treating or preventing COVID-19.

Ivermectin, an antiparasitic drug, has been the subject of controversy throughout the COVID-19 pandemic. Despite its approval for treating other conditions, the FDA discouraged its use for COVID-19, leading to a divisive debate among healthcare professionals and the public. Critics of the FDA’s stance argue that its messaging hindered access to a potentially effective treatment, contributing to avoidable deaths.

Physicians who advocate for the use of ivermectin view the settlement as a vindication of their efforts to promote alternative treatments for COVID-19. Dr. Pierre Kory, a prominent proponent of ivermectin, commended the plaintiffs for challenging the FDA’s authority and expressed hope that the case would serve as a precedent for future disputes over government health agencies’ interventions in medical practice.

The lawsuit, filed by Drs. Bowden, Marik, and Apter, alleged that the FDA overstepped its authority by discouraging the use of ivermectin for COVID-19 treatment. While an initial dismissal of the case cited sovereign immunity, an appellate court later ruled in favor of the plaintiffs, stating that the FDA exceeded its regulatory authority. The settlement follows this ruling and marks a significant development in the ongoing debate over ivermectin’s role in combating COVID-19.

The outcome of the lawsuit raises important questions about the role of regulatory agencies in shaping medical treatment protocols. By challenging the FDA’s directives, the plaintiffs assert the primacy of the patient-physician relationship and advocate for greater autonomy in medical decision-making. Moving forward, the settlement may influence how healthcare professionals navigate the complex landscape of COVID-19 treatment options.
